Terms of Service.
Last updated: September 24, 2026 · What changed: Spark Living Brands and the Spark Mosaic (Sections 5 and 7), changes to features (Section 13) and how disputes are resolved (Section 14). Earlier today: a new picture from the Art Department now uses 3 credits (it was 2).
1. What SparkMyName provides
SparkMyName™ (“SparkMyName,” “we,” “us”) is a Brand Intelligence platform that generates brandable business names and Brand Identity Strategy — which may include domain-availability suggestions, taglines, color palettes, font pairings, brand voice, social-handle ideas, a bio, and launch copy. Everything we deliver is provided for informational and creative purposes to help you build your own brand.
2. What SparkMyName is not
We do not provide legal advice, trademark clearance, financial advice, domain registration, or business-formation services. The trademark screen included with every name is an automated preliminary check of live trademark records in U.S. and international registers for the name and business type at the moment it runs (see Section 7); it is not a comprehensive clearance search, legal advice, or a guarantee that a name or logo is available or registrable. Using SparkMyName does not create an attorney-client relationship, and nothing we deliver should be treated as a substitute for professional legal, financial, or tax advice.
3. Your responsibilities
- Domain availability changes constantly. Confirm a domain is still available with a registrar before relying on it — you own a domain only once you register it.
- Before using or registering any name, run your own business-name, trademark, and common-law searches, and consult a qualified attorney where appropriate.
- You are solely responsible for how you choose, register, and use any name or material we suggest.
- You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract to use the service. SparkMyName is built for people starting or running a business and is not directed at children.
4. Domains and availability
Where we show a domain as available, that reflects an automated check made at the time your package was built. Availability can change at any moment, and we do not register domains on your behalf. We make no guarantee that any suggested domain is or will remain available, or that any name is free to use.
5. Pricing and payment
A Brand Identity Strategy is a one-time purchase of $49 USD. While founding places last, our first 100 customers pay $39 (a $10 founding discount, applied automatically at checkout; once the 100 places are taken it ends). There is no subscription and no recurring charge. Payments are processed securely by our payment processor; we never see or store your full card details. We may change our pricing for future purchases, but the price you paid for a completed order will not change.
Credits. Every order includes 30 credits. Each credit is worth $1 of SparkMyName work: a new picture from the Art Department uses 3 credits, a short video uses 1 credit per second (15, 30 or 60), building the full identity for a second name uses 5, and bringing a second brand on the same order to life with Spark Living Brands uses 15; HD versions and resizing are free. Additional credits are sold in one-time packs of exactly 10, 20, 50 or 100 credits for $10, $20, $50 or $100 — no custom amounts and no automatic top-ups. Credits never expire and belong to the order they came with (shared by all six names in that order; packs bought from a Studio are added to that order). Credits are service credits for SparkMyName work, not cash: they have no cash value, cannot be transferred or sold, and are never redeemable for money. Credit packs are non-refundable once any credit from the pack has been used. Referral credits (10 credits added when someone orders through your share link) are a gift, are not paid for self-referrals, and may be withdrawn if the referred order is refunded.
Short videos. Every order includes one 15-second video, made in your Studio. Further videos are paid with credits — 15, 30 or 60 credits for a 15-, 30- or 60-second film — taken when filming starts. Each film is produced automatically from your brief and your brand’s name, colors and logo, and delivered to your Studio with a notification by email. If a film cannot be produced, its credits (or its included-video place) are returned automatically.
How a video is made, and what you get. Spark videos are generated with artificial intelligence: the scenes and any people in them are AI-created and are not real individuals or real locations, the narration is a synthetic voice, and the background music is instrumental music generated through a licensed music service. Each order is one creative direction, delivered as one final cut in the single shape (vertical, square or wide) you select, with an optional caption track and a brand end card. A small wording correction is included; a different concept, additional scenes, extra formats, or new generations are a new paid video. Every video is labeled as AI-generated. You own the finished video and may use it in your own digital and online marketing — including social media, your website, email and paid online advertising — for the business it was made for; broadcast television, radio, cinema or other mass-media distribution is not included without a separate written license from us. You may not resell it as stock footage or present it as unmodified live-action footage of real people or events. Do not use it to imply endorsement by any real person, or in any way that breaks our Acceptable Use policy.
Spark Living Brands. When you choose one of your brands with “Make this my brand,” Spark can bring it to life with pieces made from that brand’s own name, colors, fonts and logo (for example a moving logo, a short launch film, wall art and a brand book). This is included for one brand per order; another brand on the same order uses 15 credits, and you see the price before anything is used. The pieces are drawn on your own device and are labeled as AI-made in your Studio. Your contact page and brand book page can be seen by anyone who has the link.
6. Refunds
If you are not satisfied, you may request a full refund within 7 days of delivery. See our Refund Policy for details. This guarantee is in addition to any rights or remedies you have under applicable law; nothing in these Terms or our Refund Policy excludes or limits rights that cannot lawfully be excluded or limited. Your package is delivered digitally and immediately after payment, and by completing checkout you ask for that immediate delivery and acknowledge that, where a statutory right to cancel a digital purchase exists, it may end once delivery begins — the 7-day refund above still applies. A short video that cannot be produced returns its credits automatically; for any other question about a video order, contact us within 7 days of the order.
7. Intellectual property
The SparkMyName platform, its Brand Intelligence framework, software, design, and content are owned by VORREX IGNITE LLC. U.S. patent application pending: Application No. 19/704,386. The platform’s software, design and content are also protected by copyright and may not be copied, resold or reverse-engineered. “SparkMyName™” is a claimed trademark. You may use the names and creative materials delivered in your package to build and operate your own business. Because names are generated by AI, we cannot and do not guarantee that any name is original, unique, or available for trademark or other use — that is your responsibility to verify (see Section 3).
AI-generated images and copy. Logos, icons, photos, social graphics, Art Department pieces, taglines and launch copy in your package are produced by AI models from your description and your requests, and are labeled as AI-generated in the files themselves (see our Content Credentials page). You receive a perpetual, worldwide, royalty-free right to use, modify and commercially exploit those materials for your own business, and we will not deliver the same generated image to another customer. Because copyright law in many jurisdictions, including the United States, does not protect works created without human authorship, we do not warrant that a purely AI-generated image is copyrightable or that you will hold exclusive rights in it, and we do not warrant that a generated logo or picture is free of resemblance to any existing work or mark. We do not claim ownership of your generated materials.
What you bring stays yours. When you bring your own business to Spark (your name, website, logo, colours, photos, flyers or sketches), you confirm it is your business or that you have the owner’s permission, and that you have the right to use what you upload. You keep every right you already had in those materials. You give SparkMyName a limited license to use them only to read your brand, make your pieces and show them in your Studio. Spark reads only the public pages of the website you give it.
The Spark Mosaic. When a brand comes to life with Spark Living Brands, SparkMyName may show that brand’s name, colors and logo as one tile in the Spark Mosaic, a public artwork of brands made on Spark, on our website and in our marketing. If you would like your tile removed, ask us at support@sparkmyname.com or through our Help page.
Trademark screening is not clearance. The trademark screen in your package is an automated preliminary check of live trademark records in U.S. and international registers for your name and business type at the moment it runs. It is not a legal opinion, a clearance search, or a guarantee of registrability, and it does not cover every jurisdiction, common-law use, design mark or pending application. Before you invest in a name or a logo, have a qualified attorney search and advise you.
8. Disclaimer of warranties
The service and everything delivered through it are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that any name or domain will be available, registrable, or free of conflict. You use the service and its output at your own discretion and risk.
9. Limitation of liability
To the maximum extent permitted by law, SparkMyName and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost domains, or business losses, arising from your use of the service or any name or material we provide. Our total liability for any claim relating to the service will not exceed the amount you paid for the order giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless SparkMyName and its owner from any claims, damages, or costs (including reasonable legal fees) arising out of your use, registration, or commercialization of any name, domain, or material connected with the service.
11. Acceptable use
You agree not to use the service for any unlawful purpose, not to attempt to copy, resell, scrape, or reverse-engineer the platform, and not to misuse it in any way that could harm SparkMyName or other users. Our full Acceptable Use Policy is part of these Terms. In short: you will not ask us to generate images of real, identifiable people; images that copy or imitate another company’s name, logo, character or trade dress; or sexual, violent, hateful, deceptive or otherwise unlawful content. Requests that match these categories are screened automatically before any image is made; the screen is a list of words and patterns, so it can miss things and can occasionally stop an innocent request. Repeated attempts to get around it may result in the closure of your Studio without refund.
Your disclosure and use obligations. You are responsible for how you publish the materials we deliver. That includes labeling AI-generated or altered imagery where an advertising platform, marketplace or law requires it (for example in political, health or financial advertising; under the EU Artificial Intelligence Act’s transparency rules if you market in the European Union; and under state laws on synthetic media), keeping the content-credential metadata in the files intact rather than stripping it, not presenting a generated picture as a real photograph of a real person, place or product when that would mislead, and not using generated materials to make health, financial or other claims you cannot substantiate. We embed disclosure metadata and ship a plain-text notice with every kit to help you meet these obligations, but compliance with the platforms and laws that apply to your business is yours.
Reporting a problem with an image. If you believe any image we generated infringes a right you hold, or depicts you without your consent, our takedown page explains how to tell us. We act on valid notices promptly and replace an affected customer’s image at no charge.
12. Affiliate links and third-party services
Our Resources page and some other pages link to independent third-party companies (for example, business-formation, registered-agent, trademark, domain, hosting, payment, and marketing services). SparkMyName™ does not provide these services and is not responsible for them. Some of these links may be referral or affiliate links: where we have a partnership with a provider, SparkMyName™ may earn a referral fee if you sign up, at no extra cost to you. This never changes the price you pay or which tools we choose to list, and it is not a recommendation that any particular service is right for you. Always review each provider’s current pricing and terms, and consult a qualified professional before making legal, tax, or financial decisions.
13. Changes to features
We may change, upgrade, replace or discontinue any feature, tool or technology at any time, including for reasons outside our control. If we discontinue a paid feature, credits you have not used stay in your account for other Studio work.
14. Disputes
Any dispute between you and SparkMyName™ (VORREX IGNITE LLC) will be resolved by final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Palm Beach County, Florida. You and we each waive a jury trial and the right to bring or join a class or collective action; claims may be brought only individually. Either side may instead bring an individual claim in small claims court in Palm Beach County, Florida. The Federal Arbitration Act and Florida law govern this section.
15. Updates to these Terms, governing law, and contact
We may update these Terms from time to time; the “last updated” date above reflects the current version. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Questions? Email support@sparkmyname.com.
